Heligonka - Progress Videos

This song is called If I Were a Bird Polka. When I uploaded the video it got marked with Copyright. It said it won't affect the video in any way because it isn't a Copyright Strike. I don't know whether to feel sad or almost happy because at least YouTube was able to recognize the song.
 
I have had several hits and one request from some zealot in Brazil to remove my Besame Mucho video. I'm like "yeah, not happening"... I don't monetize so he can complain all he wants and can get all the money I (don't) make off of it... lol

I enjoy the ones where I see that its a copyright hit but the owner permits it. If I can find them, I always try to send them a note and acknowledge their kindness.

There are a LOT of people that make tremendous amounts of money off of copyright hits and I can appreciate and respect copyright law, but I am not someone that makes money off of someone else's work, I'm here to play some accordion and make ZERO money from it. :)
 
My next post is the A Ja Sam Polka. I went to go watch my mentor, Brad Husak play at an event and he let me play 5 songs. It was a lot of fun! Even though I know people don't care when I make mistakes, my legs were shaking so bad. My last 3 songs went way better than the first 2. Several mistakes were made in the songs Blue Skirt Waltz and U Studánky Waltz but I am so happy with how it went.

The part that confuses me about the copyright hit is the age of the song. The majority of the songs I play are very old. I don't think they would have written it, I'm not sure though.

OK, point #1... I am not a copyright legal specialist, but I have looked up a few things concerning US laws, which may differ if you live in Canada, Mexico or where ever else someone lives.

In the USA, all audio recordings are currently under copyright protection. Because recordings only received a separate copyright from the sheet music in 1969, Congress decided to grandfather in all existing recordings with a full 95 years of protection.

So sure, you can play your own performance of compositions or sheet music that is in the public domain, (and those compositions that are still under copyright, if you have the right license can be used as well). As of 2024, anything from prior to 1929 is public domain, so if a piece you play THIS YEAR comes from the 1940's, yeah there may be a copyright infringement. Are you profiting from it? If yes, technically you may owe that money to someone. Different countries may have some later dates that are available. The cutoff date moves forward year by year.

That said, you can do whatever you want with public domain works, but bear in mind that a given performance of it may not be public domain... example, you can record Chopin's Fantasy Impromtu yourself, but you can't use the Danil Trifonov recording without his permission.

Also, YouTube is often a dunce... they may receive a complaint which is completely invalid, but force you to take it down or take away any revenue generated by this video just because they receive a well worded email from a lawyer.

The premise is that people want to basically make FREE MONEY off your work by taking YouTube channels which are monetized, point a finger at them and say "hey, I am loosing money because they are using my song" and then YouTube takes funds pointed your direction and pulls it away to give to the "copyright owner". There are several companies out there where ALL THEY DO is scour YouTube and send off copyright infringement emails all day long... valid or not. There are hundreds of millions of dollars out there to be made off the sweat of someone else's back.

*SOMETIMES* this is valid and a monetized YouTube channel may be using music without permission and making money from that video and should be charged and/or removed and in the most drastic of cases, have their account and content deleted, but most times it is an attempt at a cash grab.

The thing is that there is a way to break copyright laws, but I **highly** doubt that some dead Czech composer is going to complain loud enough that his lawyer will put a lien on your home because you made a home video of a 1943 song.

Me, I avoid the whole bullshit by acknowledging that I am here for me and for my pleasure. I am 1 small thing away from being able to be monetized (make shorts, which I hate and will NEVER do), and never wanted to become monetized and use the factor of having shorts as a prerequisite as a factor to prevent me from ever being eligible for monetization... so I use that requirement as a positive wall that will prevent me from ever becoming monetized. If YouTube tomorrow changed that requirement, I'd still find other ways to avoid that or not even accept to become monetized by YouTube.

All that said, I peripherally am aware of copyrights and generally do not try to step on anyone's toes on purpose. I was given a copyright strike by some Brazilian who claimed to be the owner of Besame Mucho (may well be true?), but I was not told to take it down, I was told that any and ALL future funds received from the viewing of this video would be taken away... sure, GO FOR IT! If you ever see it making any money, take it... please, but don't hold your breathe waiting for this to ever happen. :D :D

I used to be a professional wedding photographer. I had someone "steal" a photo from my website, claim it was theirs and sold it for a nice sum of money... money that they lost (and more) after my lawyer got through with them. If there are valid reasons for copyright infractions its quite easy to enforce them to some extent. Let's say that this gent pretty much kindly paid for my next 5-digit camera and equipment update to me and to several other photographers that he "stole" from before he lost his business, and that is the other side of copyright infringement.

That rush that you felt to perform for the first time, the excitement, the fun... its an amazing feeling and this was what got me started. I was 12 years old and walked in to the Montreal Beer Garden ( a full bar location where I was technically not even allowed to walk in to because I was way under-aged... lol), that was my first full gig and I had the time of my life, but I went in and played for 500 people both alone and mostly as part of the band. I was hooked. :D

If you get the chance to perform consistently, the big first rush dies down a little, and that is when you start to focus on the performance and where to improve on presentation and the reactions of the people.

domain, by claiming YOUR recording uses a published arrangement
that is under copyright and represented by them

Thanks for letting me know how the whole copyright situation works, I was completely unsure. I have been trying to post a new video every day for the past week and a half of the songs I currently know. I will be slowing down now both because I am running out of songs and I will have less time to make videos. I won't stop learning new songs, it just might take me a little while in between posts. I would like to continue posting, I might be able to get a good video of Blue Skirt Waltz but I'm not sure yet.

Now, Blue Skirt Waltz (Červena Sukynka, which really means red skirt... lol) is not an easy piece if you play the whole thing including the "mezihra" or middle section with the heavy bass solo, looking forward to it!
 
This song is Blue Skirt Waltz. I only know a simple version but it was a fun sing to learn.

Well done! When I get some time, I'll make my rendition of the song. In listening I can hear some of the limitations of the bass range, but still sounds good! You are ready for the next step up in performance, in trying to now look a little less serious while playing. The goal? To look like you are having as much fun as you feel you are inside. Take your time, this is not easy! :)
 
Thar is a problem I have recognized too. It is very difficult for me to smile during video just because then I overthink everything else.

It's just as hard as learning new music for sure, If your goals are just to play and enjoy your music, nothing much more for you to do. If you plan to play more in front of others or perform, it's definitely a worthy goal.

Nah my friend, likely on one of the other PAs. I'm not touching the Heligonka until I am retired, simply because I have so little free time. For me retirement is finally under a year away... hope I don't die the day after I quit my job... lol

That shouldn't happen to you. I've known many guys that died very soon after retirement. I believe the reason was that their job was their whole life. They had no other interests, so retirement was total boredom for them. It sure seems like you don't have that problem.
